Banerjee) Mr. Partha Pratim Ray Ms. Poulami Chakraborty ...for the respondent nos. 6 to 9 Petitioners have challenged an order passed by the Sub-Divisional Magistrate, Tamluk, Purba Medinipur under Section 3(1) of the West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962 by preferring an appeal under Section 7 of the said Act before the District Magistrate, Purba Medinipur.

Learned advocate appearing for the petitioners submits that though the appeal was filed on January 29, 2025, no date of hearing of such appeal has been fixed as yet.

Mr. Roy, learned advocate, appears for the respondent nos. 6 to 9.

Learned advocate appearing for the petitioners submits that a direction be passed upon the respondent authorities to dispose of the appeal within a specified timeframe.

In view of the order sought and proposed to be passed, this Court feels that there may not be any necessity to direct fresh service upon the learned Government Pleader, High Court, Calcutta.

This writ petition stands disposed of by directing the District Magistrate, Purba Medinipur to fix a date of hearing of the appeal filed by the petitioners under Section 7 of the 1962 Act and to dispose of the same as expeditiously as possible but positively within a period of four months from the date of receipt of a server copy of this order without granting any unnecessary adjournments to either of the parties. It is, however, made clear that this Court has not gone into the merits of the claims and counterclaims of the respective parties and all points are left open to be decided by the District Magistrate.
