BD CRR 1867 of 2026 Murari Jati Vs.
Amrita Sarkar Mr. Yuvraj Chatterjee Mr. Saikat Guin ...for the Petitioner. Petitioner herein is aggrieved with the delay caused in disposal of the proceeding being Complaint Case No. 651 of 2025 filed under section 138 of the Negotiable Instrument Act.
Referring section 143 of the NI Act, learned counsel for the petitioner submits that the said proceeding is required to be disposed of within a statutory period. But in the instant case, the matter is unnecessarily getting dragged on due to adjournment petitions filed one after another. Therefore, he prayed for necessary direction upon the court below for expeditious disposal of the proceeding. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party is hereby dispensed with.
Considering the submission made on behalf of the petitioner, the instant application being CRR 1867 of 2026 is hereby disposed of with a direction upon the court below
for making every endeavour for expeditious disposal of the proceeding and to make its best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing. This order is passed invoking this court's jurisdiction under section 529 of the BNS. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
