Learned advocate representing the petitioner submits that the writ petition was erroneously filed before this Court. The issue in question is already pending consideration in a suit being TS No. 1663 of 2021 in the Court of the learned 1st Civil Judge (Junior Division) at Alipore.

The petitioner does not intend to press the present writ petition.

Learned advocate representing the State respondent no. 6 submits that the writ petition is an absolutely misconceived one. The dispute is private in nature.

Upon hearing the parties it appears that the petitioner has already approached the Civil Court for relief.

There is no requirement of proceeding with the writ petition any further.

The writ petition stands disposed of.
