1. Let a copy of the application be served upon Mr. Bivasan Bhattacharya, learned counsel who ordinarily appears on behalf of the State. He is requested to represent the State in this case. His engagement may be regularized in due course.

2. Learned counsel appearing for the petitioner submits that the petitioner is an accused in the instant case. A charge-sheet was submitted under the provisions of NDPS Act showing that petitioner as an absconder. Now, the petitioner wants to join the proceeding.

3. It is surprising that the petitioner has not moved any application for anticipatory bail and instead, has approached this Court for stay of warrant of arrest.

4. I do not find any illegality in the order issuing warrant of arrest.

5. In view of the above, I find no merit in this application. Accordingly, the same is dismissed, albeit, without any order as to costs.

6. However, the petitioner is always at liberty to surrender before the learned Trial Court and pray for bail.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
