Ct. No. 28.
PRITAM [Rejected] C. R. M. (A) 1510 of 2025 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with New Barrackpore Police Station Case No.31 of 2025 dated 11.02.2025 under Sections 108/80/3(5) of BNS, 2023.
And In Re: Dibendu Roy & Ors.
...for the petitioners.
Mr. Bikash Ranjan Bhattacharjee, Sr. Adv., Mr. Dipannjan Chatterjee, Mr. Sankar Paul, Ms. Kumari Shilpa Roy .... for the petitioners.
Mr. Ayan Basu, Mr. Prabir Kr. Das, Mr. Sumit Routh ....for the de-facto.
Mr. Sandip Chakraborty, Mr. Dipankar Mahata.
.... for the State.
1.
Learned senior counsel representing the petitioners submits as follows. There are general allegations against the present petitioners who are the in-laws of the alleged victim/deceased. The prime accused is the husband who is in custody.
2.
Learned counsel appearing on behalf of the de-facto complainant opposes the prayer and submits that as would be evident from a plain reading of the post-mortem report, there were several injuries inflicted. The accused might have murdered the victim.
3.
Learned counsel appearing on behalf of the State relies on the case diary and points to the statement of a neighbor and to the statement of a relative of the victim to whom the victim had confided over telephone about the incident of torture that took place on February 10, 2025 at 11:00 p.m. All these incidents happened within one year and seven months of the marriage.
4.
Considering the statement of the relative recorded before the learned Magistrate, the statement of the neighbor and the post-mortem report, I am not inclined to grant anticipatory bail to the present petitioners. 5.
Accordingly, the prayer for anticipatory bail is rejected. 6.
CRM(A) 1510 of 2025 is dismissed.
