(Through Video Conference) Mr. Allen Felix ...for the petitioner Mr. Debashis Saha, Mr. R. Bhattacharya ....for the respondent nos.3 & 4 Counsel for the petitioner submits that the UCO Bank, Burrobazar Branch has acted inappropriately in recalling loans and advances made to his client.

It appears from the records that the bank had only recalled the advance and has not initiated any proceedings.

This Court is of the view that the writ petition is rather premature. The petitioner's right to seek appropriate remedy may arise before the appropriate forum as and when the bank initiates any proceedings in accordance with law. However, the instant order shall not prevent the bank from considering the petitioner's request for concession on interest. With the aforesaid observations, WPA 10745 of 2021 shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
