07.10.2021 tkm/ct 29 C.R.M. 4228 of 2021 sl no. 71 In Re : An application for anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Palashipara P.S Case no. 239 of 2020 dated 2.9.2020 under sections 21(c)/29 of the NDPS Act And In Re : Hasibul Mondal ...... petitioner Mr. K Bagchi Mr. A Islam Mr. S Mukherjee ...... for the petitioner Mr. Sudip Ghosh Mr. B Banerjee ...... for the State Petitioner seeks anticipatory bail.

Learned advocate for the petitioner submits that no contraband was recovered from the possession of the petitioner. The recovery was made from the house of the petitioner. Learned advocate for the State submits that although intermediate quantity of heroin was seized from the house of the petitioner, police also came across weighing machines and huge amount of currency notes.

Considering the materials in the case diary and considering the fact that contraband was recovered from the house of the petitioner albeit of intermediate quantity alongwith weighing machine and currency, we are not inclined to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail is rejected. (Ananda Kumar Mukherjee, J.) (Debangsu Basak, J.)
