1. In pursuance of the direction passed by this Court earlier on 28.04.2025 communication has been sent to the Commissioner of Police and a report has been submitted by the concerned police station indicating that the notices have been duly served upon the parties to the case.

2. Learned Advocate representing the appellant is present.

3. Respondent/accused person is also represented.

4. It is submitted by the learned Advocate for the appellant that the present appellant does not intend to proceed further with the appeal.

5. The instant appeal is preferred by the appellant challenging the impugned judgment and order of acquittal passed by the learned Trial Court. As the appellant does not intend to proceed with the appeal, the same is to be disposed of on merit.

6. I perused the impugned judgment and order passed by the learned Trial Court and finds nothing to interfere with it.

7. Accordingly, the instant appeal be and the same is dismissed on merit affirming the impugned judgment and order of acquittal passed by the learned Trial Court.

8. Thus the Criminal Appeal be and the same is hereby disposed of.

9. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court immediately.

10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
