The appeal has been preferred against an order passed by the learned Judge, Bench-V, City Civil Court, Calcutta on April 04, 2022 in T.S. No.749 of 2022. We have been informed by learned counsel appearing for the respondent that by an order dated September 12, 2023, the suit being T.S. No.749 of 2022 has been 'dismissed for default' and has not been restored as yet. In view thereof, this appeal has become infructuous and is thus, dismissed.

Interim order, if any, stands vacated.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned advocates for the parties.
