2021-12-16Hon'Ble Justice Bibhas Ranjan De1 pages

16.12.2021 sl.13, sk ct.29 C.R.R.1593 of 2011 In the matter of Smt. Sadheswary Bhalla @ Mani Bhalla...petitioner. None appears on behalf of the contesting parties to this revisional application.

This revisional application is taken up for hearing. From the record it appears that on 13.9.2011, the petitioner is directed to cause service upon the opposite party. I do not find any such compliance from the record till date. From the record it appears that this revisional application was directed against the judgement passed by the learned Additional District and Sessions Judge, Kandi, Murshidabad passed on 17th March, 2011 whereby the learned Judge reduced the quantum of maintenance from Rs. 2,500/- to Rs. 1,500/- in total. From the judgement, I do not find any illegality or irregularity in the judgment in revision, awarding maintenance by the Magistrate under Section 125 of Cr.P.C.

The revisional court has no power to re-assess the evidence and substituting own findings the questions or quantum of maintenance, in view of the matter, I do not find any illegality or irregularity in the judgment.

The learned Registrar (Judicial Services) is requested to communicate this order to the learned Additional District and Sessions Judge, Kandi, Murshidabad forthwith.
