The present appeal has been preferred challenging the order dated 6th April, 2022 passed in Title Suit no.780 of 2022.

No one appears today on behalf of the appellant and no accommodation has been sought for.

Ms. Ojha, learned advocate appearing for the respondent-bank submits that the present appeal has become infructuous since the Title Suit no.780 of 2022 has already been withdrawn by the appellant on 20th February, 2023. Let a copy of the order, as placed, be kept on record.

In view thereof, the present appeal and the connected application, if any, are dismissed. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
