The appeal preferred by the appellant who happens to be the complainant is in respect of Kakdwip Police Station Case No. 539 of 2013 dated 04.11.2013 under Sections 143/323/506/427 of the Indian Penal Code. The judgement is delivered by the learned Additional Chief Judicial Magistrate, Kakdwip, South 24 Parganas. Considering that the judgement was delivered in a magisterial triable offence if the complainant or the victim is aggrieved, the appeal is to be preferred before the learned Sessions Judge.

Accordingly, CRA (SB) 69 of 2023 is dismissed as withdrawn. The appellant is granted liberty to prefer appeal before the learned District and Sessions Judge, 24 Parganas(South). The appellant is further directed to approach the Department for taking back the certified copy and replacing the same by a Photostat copy.
