1. Let affidavit of service, as filed in Court, be kept on record.

2. In spite of service, there is no representation on behalf of the respondents.

3. The petitioner seeks execution of the order passed by the respondent no. 2 on October 19, 2022.

This order was not executed in view of the order passed by this Hon'ble Court on July 29, 2022, directing that the Bank will not take any further steps in respect of the notice of sale. Application has been heard and disposed of by the Debts Recovery Tribunal-III, Kolkata, by its order dated April 18, 2023.

4. Since there is no impediment at present and the protection afforded by the order of July 29, 2022, by this Hon'ble Court, has reached its logical conclusion, the Bank is at liberty to proceed with executing the order of the respondent no. 2.

5. The authorities are directed to render all assistance to the Bank to enable execution of the order of the respondent no. 2 upon payment of the requisite costs by the petitioner.

6. With the aforestated directions, the writ petition is disposed of.

7. There shall, however, be no order as to costs.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
