In the instant writ petition the petitioner claimed promotion to the rank of Inspector Grade-2 with effect from 01.04.1983 along with cash benefits with effect from 01.01.1984 due to restructuring of the cadre as per Railway Board Circular dated 6th February, 1984 issued by the Joint Director, Establishment (D & E), Railway Board, New Delhi. The writ petition was filed on 25th June, 2003. It is found from the affidavit sworn by the petitioner that he was 58 years of age on the date of filing of the writ petition. At present, the writ petitioner is aged about 76 years. The matter is running in the list for the last one month. The petitioner was never represented by his learned advocate.

Conduct of the petitioner thus suggests that on his attainment of superannuation age he is not willing to proceed with the instant writ petition. Accordingly, the instant writ petition is dismissed for default.
