Mr. Subhankar Mondal ... for the appellants/claimants Mr. Rajesh Singh ... for the respondents/Insurance Company The instant appeal was filed being aggrieved by the inadequate compensation granted in favour of the appellants/claimants in an application under Section 166 of the Motor Vehicles Act, 1988 resulting in the death of the victim in road traffic accident with regard to MAC Case No. 274 of 2018 passed by the learned Additional District & Sessions Judge, RD Court, Paschim Medinipore-Cum Motor Accident Claim Tribunal. During the pendency of the instant appeal the disputes between the parties have been resolved.

The respondents/Insurance Company is to pay a further sum of Rs. 1,80,000/- to the appellants/claimants which has been duly accepted by the appellants/claimants. The claimants have already received a sum of Rs. 9,60,000/- along with interest of Rs. 9% per annum from the date of filing of the claim application to the appellants/claimants in respective proportion in consonance with the order of the learned tribunal. The Insurance Company is to deposit the additional sum of Rs. 1,80,000/- before the office of the learned Registrar

General, High Court Calcutta within six weeks from the date of passing of this order.

On receipt of the said amount, the Registrar General, High Court, Calcutta shall encash the said cheque and thereafter disburse the same to the present appellants/claimants in the proportion as mentioned in the award granted by the learned MACT.

With the above observation, the instant appeal is disposed of.

All the interim order if any stand vacated.

Copy of the order along with lower court records be sent to the Department as well as the concerned tribunal as expeditiously as possible.
