Atindranath Chatterjee (In Person) appearing on behalf of the petitioner as well as Mr. Jahar Lal De, AGP, learned counsel appearing on behalf of the State.

The instant writ petition has been filed in the nature of PIL by the petitioner praying inter alia for the following relief(s):- "a) A writ of/in the nature of Mandamus directing the Respondent No. 3 including its men, agents, assigns subordinates, to immediately initiate proceedings for eviction of postal authorities, including Respondent No. 5, from the Government Premises being flat no.
L-49 flat no.
L-50 of Sagarbhanga LIG Housing Estate and
take vacant possession of these flats and marshal up those flats to the pool of the vacant flats to cater to applicants standing in the queque for a long time.
b) A writ of/in the nature of Mandamus directing the Respondent Nos. 6 & 7 including its men, agents, assigns and subordinates, to immediately arrange to remove all the unauthorized constructions made inside appertaining the area of the flat being no.
L-50 and restore the flat to the original condition.
c) A writ of/in the nature of Certiorari directing the Respondent No.
to transmit and authenticate the records of this case to this Hon'ble Court so that conscionable Justice may be administered.
d) Rule NISI in terms of the prayers (a) to (c) above and to hear the parties and make the Rule absolute if no cause or no sufficient cause is shown.
e) Ad-interim order in terms of the prayers (a) to (c) above.
f) Costs incidentals of this application.
g) Such further and/or other orders and/or such further and/or other directions as this Hon'ble Court may deem fit and proper."

In a nut shell the main grievance of the petitioner is with regard to the non consideration of a request dated 2.4.2025 made before the
respondent No. 3. The issue involved herein is the eviction of an unauthorized occupant being Sagarbhanga Colony post Office for occupying to flats in violation of the statutory norms.

The learned counsel for the respondent vehemently opposes and takes the point of maintainability also submits that the property in question is a government property and the post office is running and serving the public at large. The flats in question are being let out to the postal authorities upon prior permission obtained from the government supremo of post office.

In conspectus of the above, prima facie it appears that the petitioner has ventilated his own grievance under the garb of filing the instant PIL. 6.
The PIL is dismissed in limini.

No order as to costs.
