It appears that the instant application is filed under Article 227 of the Constitution of India with a prayer for early hearing of Misc. Appeal No. 19 of 2011 which is pending before the Learned District Judge, Hooghly at Chinsurah.

The plaintiff/petitioner filed a suit being No.361 of 2009 before the Learned Civil Judge (Junior Division), Chinsurah, Hooghly and in that suit an application was taken up by the petitioner filed under Order 39 Rules 1 & 2 with a prayer for temporary injunction.

The defendants/opposite parties entered their appearance in that suit. After contesting hearing, Learned Trial Court rejected the application filed by this petitioner for temporary injunction on contest. Thereafter an appeal was preferred before the Learned District Judge, Hooghly at Chinsurah challenging the said order of rejection of temporary injunction by this petitioner. But that matter has not been disposed of till the filing of the revisional application.

Although parties to this case are not present before this Court, but I feel that a direction is to be passed upon

the District Judge, Hooghly at Chinsurah to dispose of Misc. Appeal No. 19 of 2011 pending before his Court as expeditiously as possible.

Accordingly, Learned District Judge, Hooghly at Chinsurah is hereby directed to decide/dispose of the Misc. Appeal No.

of pending before his Court expeditiously within two months from the date of communication of this order if it has already not been decided/disposed of.

Let a copy of this order be sent down to the Learned District Judge, Hooghly at Chinsurah for necessary compliance.

Accordingly, C.O. No. 1208 of 2015 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties on compliance of necessary formalities.
