Kausik (Allowed) CRM (M) 1109 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Dasnagar Police Station Case No. 129 of 2023 dated 16.08.2023 under Sections 302/201/120B of the Indian Penal Code, 1860.

And In the matter of : Suman Jamadar ......Petitioner.

Mr. Krishnendu Bhattacharya Mr. Anamitra Banerjee ......for the State.

Petitioner is in custody for more than 2 years and 9 months and till date it has been pointed out that out of the 21 witnesses cited in the charge sheet only 2 witnesses have been examined. Learned advocate for the petitioner further submits that petitioner is similarly situated as Sudip @ Sudip Chatterjee in CRM (DB) 3468 of 2024 and CRM (DB) 1583 of 2024. Petitioner, therefore, prays that the present petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail, but on a query from this Court, is unable to refute the contention of the petitioner that the petitioner is similarly situated as the other accused persons who have been granted bail.

Having regard to the period of detention of the present petitioner and only 2 witnesses have been examined out of the cited 21 witnesses, I am inclined to release the petitioner on bail.

Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Suman Jamadar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Howrah.

If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Howrah without prior permission of the learned Trial Court.

The petitioner shall for the next 6 months meet with the Officer-in-Charge/Inspector-in-Charge of Dasnagar Police Station. It would be the discretion of the Trial Court, after 6 months to decide whether to continue the condition or waive such condition.

Accordingly, CRM (M) 1109 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
