Mr. Banshi Badan Maity ....for the petitioner 1) In terms of previous order notice served upon learned advocate representing State respondents is placed before this Court and same is taken on record.

2) In spite of service of notice, State respondents are not represented.

3) Petitioner is the wife of deceased retired Assistant Teacher, who superannuated on 31st January, 2020. Due to superannuation of husband of the petitioner, first Pension Payment Order was issued on 31st January, 2020 and as per first Pension Payment Order disbursement of retiral dues was made in favour of husband of the petitioner. Subsequently, due to revision of pay as per ROPA 2019 revised Pension Payment Order was issued on 19th January, 2021. Thereafter husband of the petitioner died on 13th May, 2023. Petitioner claims interest on revised gratuity as per revised Pension Payment Order due to delayed payment.

4) Accordingly, the Director of Pension Provident Fund and Group Insurance and the concerned Treasury Officer are directed to pay interest at the rate of 8% per annum to petitioner on revised gratuity as per revised pension payment order from 14th February, 2020 till the date of actual disbursement of the revised gratuity within a period of eight weeks from the date of communication of this order. 5) Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted. 6) With the above observation, the writ petition stands disposed of.

7) There shall be no order as to costs.

8) Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings. (Saugata Bhattacharyya, J.)
