27.04.2023 Ct. No. 29 KAUSHIK REJECTED C.R.M.(A) 1794 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Baishnabnagar Police Station Case No. 35 of 2022 dated 09.01.2022 under Sections 411/413/414 of the Indian Penal Code.

And In Re : Sadikul Islam ...... petitioner Mr. Arup Kumar Bhowmick ....for the petitioner Mr. Rudradipta Nandy Ms. Sonali Das ....for the State The police case is dated January 9, 2022.

There is an issue of absconsion of the petitioner. There are materials in the case diary, which suggest complicity of the petitioner in cattle smuggling. In such circumstances, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1794 of 2023 is dismissed.
