It is submitted that the petitioner and his wife had taken custody of a minor for his welfare and adoption.

Learned lawyer for the State opposes the prayer for bail and submits that the petitioner and other co-accuseds including his wife were trafficking in minor children.

We have considered materials on record including the statements of witnesses recorded under section 164 Cr.P.C showing that the petitioner and his wife had illegally procured three minor children. This circumstance militates against the claim of the petitioner regarding bona fide adoption of minor. Keeping in mind the facts and circumstances of the case and the gravity of the offence, we are of the opinion that this is not a fit case to grant bail to the petitioner.
