The present revisional application was preferred by the petitioner for quashing the proceedings relating to Burrabazar Police Station/DD Part II/Case No. 3 of 2021 dated 28.01.2021.

Mr. Bhattacherjee, learned advocate appearing for the petitioner submits that the petitioner is innocent and has been falsely implicated in the instant case. Learned advocate submits that the petitioner was an employee of a particular Company who on instructions was carrying out his duties. Mr. Sur, learned advocate appearing for the State produces the case diary and submits that on 08.11.2022, the Investigating Officer of the case has already filed a report with his finding that no case could be established against the present petitioner, Mithilesh Yadav and he be discharged as an accused person from the case due to mistake of fact and want of evidence.

In view of the aforesaid, this revisional application has become infructuous. The revisional application being CRR 1376 of 2021 is, thus, dismissed as infructuous. All pending connected applications, if any, are consequently disposed of.

The Investigating Officer of the case is present in Court. His further appearance before this Court is dispensed with. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
