Sri Susanta Sarkar Mr. Subrata Ghosh, Mr. Abhijit Biswas ...for the petitioners A direction to secure expeditious disposal of an application filed by the petitioner namely, Susanta Sarkar is the ultimate relief sought for in this case. It is submitted by learned advocate for the petitioners that in pending Succession Case No.105 of 2017, of learned District Delegate, Alipore, petitioner filed an application dated 31st January, 2018 alleging that pending Succession Case should be dismissed for the facts being set out in such application.

No other point is raised requiring address by this Court.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite parties stands dispensed with.

Accordingly, learned District Delegate, Alipore, in connection with Act 39 Succession Case No.105 of 2017 is requested to ensure expeditious disposal of

referred interlocutory application, providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable. This would not, however, prevent the petitioners from filing an appropriate application supported by the copy of referred interlocutory application with a prayer for fixation of suitable date of hearing, upon notice to the other side.

Petitioner is directed to make communication of this order to the learned court below as well as to the opposite party and his learned advocate in the court below.

With this observation/direction, the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
