Petitioner is aggrieved by the fact that inspite of representation being made to the Officer-in-Charge, Belgharia Police Station, no steps have been taken. Petitioner claims that he has been threatened by the private respondents on the issue that there are dues which are lying with him. To that extent petitioner apprehends that there is every possibility of the respondents taking law in their own hand.

State has submitted a report. Report reflects that police authorities have enquired and found that no cognizable offence has been made out.

Learned advocate for the private respondent no.5 submits that he is a whole-seller from whom petitioner has taken goods/potatoes on credit but subsequently, did not remit or refund the amount for which the goods have been taken.

Be that as it may, prima facie, even if the facts are accepted to be correct, there may be a breach of commitment. However, there are allegations of threat which has been made to the police station.

Having regard to the same, I direct that in case the petitioner has document in his custody, he would approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would take recourse under the relevant provisions of law.

Police authorities would ensure that no untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations WPA 10045 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
