Ms. Ina Bhattacharyya .....for the petitioners Ms. Sukla Das Chandra ....for the State Petitioner being widow daughter has claimed sanction of family pension since father of the petitioner was a teacher who died on 21st May, 2002.
It is submitted that after superannuation father was receiving pension.
Mother pre-deceased father. Though at the time of death of father petitioner was married but unfortunately petitioner lost her husband on 4th March, 2020. Therefore petitioner is entitled to receive family pension in connection with service rendered by her father.
Learned advocate representing State respondents has placed before this Court a memo dated 17th June, 2025 of the District Inspector of Schools (PE), Purba Medinipur and same is taken on record.
From said memo dated 17th June, 2025 it appears that pension file of the petitioner was
forwarded to the Director of Pension, Provident Fund and Group Insurance being respondent no. 2 for sanction of family pension with effect from 5th March, 2020.
Since papers relating to family pension case have already been forwarded to respondent no. 2, respondent no. 2 is directed to issue Pension Payment order in favour of the petitioner by four weeks from date of communication of this order on compliance of necessary formalities.
Writ petition stands disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
