Gopal Mondal v. State Of West Bengal
06.07.2022 Sl. No.6 akd [Rejected] C. R. M. (NDPS) 517 of 2022 In Re: An application for bail under Section 439 of the Code of Criminal Procedure filed on 30.03.2022 in connection with Bhimpur Police Station Case No.263 of 2021 dated 13.09.2021 under Section 21(c) of the NDPS Act.
And In Re: Gopal Mondal ... ... Petitioner Mr. Sekhar Kumar Basu .. Sr. Advocate Mr. Antarikhya Basu Ms. Madhumita Basak Ms. Sohini Bardhan ... ... for the petitioner Mr. Binay Panda Mrs. Puspita Saha ... ... for the State Pursuant to our earlier direction, Investigating Officer is personally present before this court. His presence is noted and dispensed with.
Affidavit filed on behalf of the Investigating Officer is placed on record.
We have perused the affidavit. It appears that the seized consignment was inventorised on 14.12.2021 and the matter was reported to the court concerned on 17.12.2021. Such fact is also reflected in the charge-sheet filed on 26.01.2022. In view of the aforesaid compliance albeit belatedly by the Investigating Agency and in the light of the other materials on record, we are of the opinion this is not a fit case to grant bail to the petitioner at this stage.
However, we direct the trial court to expedite the trial and conclude the same at an early date preferably within six months from
the next date fixed for recording evidence without granting unnecessary adjournments to either of the parties.
