Affidavit-of-service filed in Court today is taken on record. None appears for the respondents.

The petitioner prays for consideration of the representation dated 27th March, 2023 submitted before the Executive Officer, Purulia Zilla Parishad seeking grant of notional benefit in terms of the direction passed by this Court on 28th August, 2018 in W.P. 31099 (W) of 2017 with CAN 3313 of 2018 (Durga Das Pramanick & Anr. -vs- State of West Bengal & Ors.).

It has been submitted that the petitioner stands in the same footing as that of Durga Das Pramanick (Supra). Similar order that has been passed on 28th August, 2018 in the matter of Durga Das Pramanick (Supra) may be passed in the case of the petitioner. The representation filed by the petitioner seeking similar benefit appears to be pending consideration before the respondent Zilla Parishad.

In view of the above, the instant writ petition is disposed of by directing the respondent no. 6 being the Executive Officer, Purulia Zilla Parisahd to consider the representation filed by the petitioner and decide as to whether similar relief as granted in the matter of Durga Das Pramanick (supra) may be allowed in favour of the petitioner.

A decision shall be taken in the matter after giving reasonable opportunity of hearing to the petitioner for production of necessary documents in support of their stand.

Decision shall be taken at the earliest but positively within a period of twelve weeks from the date of communication of this order.

Learned advocate appearing for the petitioner is directed to forward a copy of the subject representation along with a copy of the order dated 28th August, 2018 passed in the matter of Durga Das Pramanick to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
