According to the petitioners, the private respondents are disturbing the peaceful possession of the land belonging to the petitioners. The private respondents are preventing the petitioners from cultivating their land.

Learned advocate appearing for the State submits on the basis of written instructions that, the police inquired into the complaints lodged from time to time. On inquiry the police learnt that there are proceeding pending under the West Bengal Estates Acquisition Act, 1953. Against an initial order of dismissing the application of the petitioners before the Block Land and Land Reforms Officer, an appeal was carried. The Tribunal exercising appellate jurisdiction remanded the matter to the Block Land & Land Reforms Officer for reconsideration in view of an order passed in a writ petition.

Apparently, there are disputes between the private parties with regard to immovable property concerned. Such disputes are receiving the attention of the Authorities under the Act of 1953. At this stage, it would be inappropriate for the writ court to intervene.

WPA 10809 of 2021 is disposed of accordingly. (Debangsu Basak, J.)
