Banerjee ....For the Respondent Nos. 1 and 2 In the instant writ petition, the petitioner prayed for reinstatement to the service as he was placed under suspension during the pendency of the disciplinary proceedings. Furthermore, the petitioner prayed for stay of the disciplinary proceedings till the disposal of the criminal case pending before the learned Court at Chandannagar. During the pendency of the writ petition, a final order of "dismissal" was passed by the respondent authorities. It appears from the said final order that several opportunities were given to the petitioner to attend personal hearing scheduled on May 12, 2023. The personal hearing was again rescheduled on May 22, 2023. It was on May 22, 2023 that the petitioner appeared.

Since the final order of penalty has already been passed, the cause of action in the present writ petition has become infructuous. Therefore, W.P.A. 10040 of 2023 is dismissed.

The petitioner may challenge the subsequent events, if so advised.

Since no affidavits have been directed to be exchanged in the present writ petition, all the allegations contained in the writ petition are deemed not to have been admitted by the parties.

All parties shall act on the server copy of this order duly downloaded from the website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all the formalities.
