In view of the earlier order, Mr. Bapuli, learned APP submits photostat copy of the report so submitted by the concerned officer of Pradhan Nagar Police Station which reflects that the petitioner is not traceable. A copy of the said report be kept with the record.
The learned advocate for the petitioner has already made his submission earlier.
This Court till date has not been apprised regarding the fact of compliance of the order dated 12.04.2017 passed by a co-ordinate Bench of this Court. As the petitioner is not willing to pursue with the revisional application before this Court, let the revisional application be dismissed. The learned Judicial Magistrate, 5th Court, Howrah is directed to execute the order passed in C.R. Case No. 1668/2014 corresponding to T.R.No. 506/2011 under Section 138 of Negotiable Instruments Act.
Accordingly, CRR 1233 of 2017 is dismissed.
Interim order, if any, is hereby vacated.
All pending applications, if any, are consequently disposed of.
