Ct. No. 28.

PRITAM [ALLOWED] C. R. M. (A) 1524 of 2025 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chapra Police Station Case No.20 of 2025 dated 08.01.2025 under Sections 281/125(b) of the BNS, 2023 & Sections 25(i)(b)/27 of the Arms Act, 1959 & Section 85 of the Motor Vehicles Act, 1988.

And In Re: Ajijul Haque Biswas.

... ... petitioner.

Mr. Debraj Shil.

.... for the petitioner.

Mr. Sandip Chakraborty, Ms. Ahana Dey.

.... for the State.

1.

Leave is granted to amend the cause-title.

2.

Learned advocate for the petitioner submits that the petitioner suffered several injuries from the accident while riding the motor bike. A fire arm was allegedly lying at a distance from the place of occurrence.

3.

Learned advocate appearing on behalf of the State opposes the prayer for anticipatory bail. He also submits that the petitioner has criminal antecedents.

4.

In view of the materials available in the case diary and the injuries that were suffered by the petitioner, I do not find that custodial interrogation of the petitioner is required in this case.

5.

Accordingly, I direct that in the event of arrest, the petitioners viz., Ajijul Haque Biswas. be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like

amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever and shall cooperate with the investigation.

6.

The application for anticipatory bail being CRM (A) 1524 of 2025 is, thus, disposed of.
