Mr. Kamalesh Bhattacharya, learned Senior Advocate for the petitioner submits that the petitioner is aged about 83 years old and is suffering from different ailments, as such, he could not appear personally before this Court in compliance with the direction dated May 15, 2024, he prays that the personal appearance of the petitioner under such circumstances may be dispensed with. He further submits that the petitioner does not want to press the writ petition. Considering such submission of Mr. Bhattacharya, the personal appearance of the petitioner is dispensed with and in view of such stand of the petitioner, WPA 10059 of 2023 is dismissed as not pressed without any order as to costs.
