As clearly evident from the submissions of counsel for the petitioner and the facts of the case, there is a purely private contractual dispute between the petitioner and the private respondent, this court sees no crime angle in the grievance of the petitioner.

Hence, Officer in Charge, Gosaba PS need not have instituted any proceeding and need not further investigate the complaint lodged by the petitioner. The petitioner may pursue suitable remedies before the civil court in accordance with law. With the above observation, WPA 10794 of 2021 is disposed of.

However, there shall be no order as to costs. (Rajasekhar Mantha, J.)
