The Commissioner of Police, Kolkata has filed an affidavit and the Officer-in-Charge, Haridevpur Police Station has also used an affidavit, which are taken on record.

The Commissioner of Police has found justification with the estimate submitted by the O.C., under his signature of a sum of Rs.12 lakhs and odd for the purpose of providing security and force to enable the petitioners to construct the boundary wall. This Court does not wish to go into the propriety of the said estimate. A sum of Rs.2 lakhs is decided as payable by the petitioners to the Kolkata Police for the purpose of deployment of force for a period of two days to construct the boundary wall on their premises. Insofar as the allegation of the bribe of Rs.5 lakhs demanded by the O. C., Haridevpur Police Station, namely, Mr.

Prasanta Majumdar, the

Commissioner of Police, Kolkata, has not found it to have been substantiated. Prior to such finding, the petitioner was summoned along with their advocates to the office of the Deputy Commissioner of Police and were also heard.

This Court does not wish to proceed further with the matter any further except to record that the O.C., Haridevpur Police Station shall act with more care, caution and introspection in future.

The Commissioner of Police shall bear in mind the allegation of the petitioner against the O.C., Haridevpur Police Station for future purposes, as may be necessary.

The contempt application shall stand disposed of.

Rule, if any, shall stand discharged.
