On July 30, 2009 the petitioner was appointed as a contractual full time lecturer temporarily of the subject film study for the period of 179 days w.e.f. August 11, 2009 at Sammilani Mahavidyalaya, Kolkata.

The petitioner subsequently, by virtue of memorandum being no. 2081-Edn (CS)/10M83/2019 dated December 23, 2019 issued by the Government of West Bengal, Higher Education Department (College Sponsored Branch), had obtained the status of State Aided College Teacher (SACT), Category -II.

The petitioner is praying that he should be given the status of SACT, Category-I teacher as he possesses the requisite qualification as per the guideline of University Grants Commission.

It appears from the record that the petitioner, praying such upgradation of his status has made representations before the different authorities. The copy of the said representations though was forwarded to the Director of Public Instruction, Department of Higher Education, Government of West Bengal, the respondent no. 4 herein but since the same has not been addressed to the said respondent, the petitioner is granted liberty to give a comprehensive representation within a week from date to the said respondent praying such relief, if such representation is made within the said time, the respondent shall consider the same as expeditiously as possible in accordance with law after giving the petitioner and the college authorities opportunity of hearing.

Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.

W.P.A. 10055 of 2025 is disposed of with the above terms without any order as to costs.
