It is admitted by both parties that during the pendency of the writ petition, the original petitioner has expired and no steps have been taken for substitution. The period for abetment has also long expired.

It is submitted on behalf the CESC Limited that the total outstanding dues are in excess of Rs.1,53,395/- (excluding interest).

The writ petition was filed in 2005 and the petitioner has not been diligent the proceeding with the same.

In such circumstances, WPA 9475 of 2005 along with connected application being CAN 1 of 2006 (Old No. CAN 75 of 2006) stands dismissed. (RAVI KRISHAN KAPUR, J.)
