The petitioner's application seeking transfer was returned on 1st October, 2021 on the ground that the petitioner did not come within the ambit of 10% of the existing teaching strength of the school.

The petitioner seeks transfer on distance ground. 3.

More than four years have elapsed from the date of rejection of her application for transfer. The petitioner did not make any further application seeking transfer after the earlier rejection. 4.

The instant writ petition stands disposed of by observing that it will be open for the petitioner to file fresh application seeking transfer.

In the event such an application is made, the same shall be considered by the head of the institution in accordance with law at the earliest

but positively within a period of eight weeks from the date of making the application.

If the application of the petitioner is allowed by the head of the institution, then necessary consequential steps shall be taken by the authority.

The fate of the application shall be made known to the petitioner.

8.

The head of the institution shall consider the documents forwarded by the petitioner in support of her application offline.

9.

Report in the form of affidavit on behalf of the District Inspector of Schools (S.E.), Howrah filed in Court today be retained with the records.

10.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
