The writ petition is disposed of with a direction upon the Officer-in-Charge, Baranagar Police Station to ensure that the order of injunction, which was passed by the learned Civil Judge (Senior Division) 1st Court at Barasat, dated April 12, 2022, in Title Suit No.326 of 2010, is implemented, provided that the said order is still in force. Both the parties are directed to maintain status quo as directed by the learned court below with regard to the nature, character and possession of the suit property, subject to any further order, that may be passed by the competent civil court or any superior forum.
The police authorities shall keep a vigil.
This order shall not be construed as an adjudication on the allegation of violation of the order of status quo. Such issue shall be raised by the petitioner before the appropriate civil court, in accordance with law.
Accordingly, the writ petition is disposed of. However, there will be no order as to costs.
All the parties are directed to act on the basis of the server copy of this order.
