FIR and statements of witnesses show that the petitioner had fled away from the spot wherefrom narcotic substance i.e. 40 bottles of phensedyl syrup containing codeine mixture above commercial quantity was recovered. Under such circumstances and in view of the statutory restrictions under Section 37 of the NDPS Act, we are of the opinion that this is not a fit case to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.
