No. 29 CHC Rejected C.R.M.(A) 1799 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with New Market Police Station Case No. 22 of 2022 dated 10.02.2022 under Sections 408/467/468/469/471/120B of the Indian Penal Code, 1860.

And In the matter of : Mamoni Mondal ...... petitioner Mr. Kallol Mondal, Mr. Krishan Ray, Mr. Partha Sarathi Mondal, Mrs. Antara Das, Mr. Md. Naimuddin ....for the petitioner Mr. Sudip Ghosh, Mr. Kaushik Kundu ....for the State Petitioner apparently worked as a Data Entry Operator with Kolkata Municipal Corporation, Birth Registration Department.

There are materials in the case diary, which suggests that petitioner was part of the racket which changed the date of birth of a person.

Prima facie case stands made out as against the petitioner.

Enlarging the petitioner on anticipatory bail may be inimical to the investigation.

In such circumstances, we are unable to grant anticipatory bail to the petitioner.

CRM (A) 1799 of 2023 is rejected.
