The petitioner has already approached the Officer-in-Charge, Joypur Police Station with the allegation that a public road has been blocked by the respondent nos. 9 to 14. According to the petitioner, the said public road is used by the disciples every year to attend the Jagannath Temple and the respondent nos. 9 to 14 acted contrary to law by blocking the said road.

As the matter has been taken up out of turn, the respondent nos. 9 to 14 could not be notified about the proceedings before this court.

Under such circumstances, this court cannot pass any mandatory direction against the respondent nos. 9 to 14, but directs the Superintendent of Police, Bankura, Chandmaridanga and the local police station to consider the contention of the petitioner and take remedial measures, if it is found on enquiry

that the allegation that a public road has been blocked, is correct.

However this order shall not apply in case the respondent nos. 9 to 14 had objected to any procession through their own land.

The court has not gone into the correctness of the allegation of the petitioner, and the police authorities shall try to settle the issue between the respective parties, amicably.

The writ petition is disposed of.

There shall be no order as to costs.
