...Petitioner
Mr. Firoz Edjulji Mr. S.K.Dan Mr. L. Maitra Mr. Kalyan Kr. Bhattacharjee ...For the Petitioner Mr. Swapan Banerjee Mr. Suman De ... for the State Mr. Bhaskar Seth Mr. M.K.Gupta ... for the de facto complainant This is the 8th attempt made by the petitioner for being enlarged on bail after having failed in six previous attempts and withdrawing the seventh application. The trial has commenced. The petitioner invites us to go into the merits of the matter, which we are not inclined to go into at this stage, as it is likely to influence the trial Court.
The petitioner says that he is in custody for about five and a half years and the trial had commenced in the year 2017. In the trial out of 26 witnesses, only 5 witnesses have been examined till date. Learned lawyer for the State opposes the prayer for bail. Having considering the materials in the case diary and the prima
facie involvement of the petitioner in the alleged crime, we are not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail is rejected. Although, we are not inclined to grant bail at this stage but for the ends of justice, we direct the trial Court to conclude the trial as expeditiously as possible.
CRM (DB) 1416 of 2022 is accordingly disposed of. (Arindam Mukherjee, J.) (Subhendu Samanta, J.)
