The petitioner seeks condonation of delay in filing the revisional application.

Heard learned counsels for the parties.

Good grounds being shown, the delay in filing the application is condoned.

The application being CRAN 1 of 2024 is disposed of. In re: CRR No. 1612 of 2024 The petitioner applied for No Objection Certificate for a period of two years for renewal of his passport before the learned 4th Judicial Magistrate, Barrackpore. The petitioner is aggrieved by the order impugned dated 11th December, 2023 passed by the learned Judicial

Magistrate in GR Case No.4764 of 2021 granting No Objection Certificate for a period of one year. The petitioner undertakes to appear before the learned Trial Court as and when called for by the Court and also not raise any objection to the evidence recorded in his absence.

Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that the order impugned dated 11th December, 2023 passed by the learned 4th Judicial Magistrate, Barrackpore in GR Case No.4764 of 2021 be modified to the extent that the learned Magistrate shall grant No Objection Certificate to the petitioner for a period of two years for renewal of his passport.

In terms of the undertaking given by the petitioner, he shall not challenge the evidence recorded in the trial in his absence provided he is represented by his learned counsel. He shall appear before the learned Trial Court as and when called for. Liberty is granted to the petitioner to appear virtually before the learned Trial Court in the event he is unable to appear physically.

In view of the above, the revisional application being CRR 1612 of 2024 is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
