Learned advocate appearing for the petitioner submits that petitioner is in custody since 8th of August, 2025 and the recovery in the present case is 325 grams of heroin, charge-sheet has been submitted and the prosecution has relied upon number of witnesses to prove its case which will consume time, as such petitioner may be released on bail.

Learned advocate appearing for the State opposes the prayer for bail.

I have considered the Case Diary which was produced and I find that in course of police custody there has been further recovery of 50 grams contraband in connection with the instant case. Having regard to the stage of the case, the quantum of contraband being of commercial quantity and rigors of Section 37 of

NDPS Act are attracted, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (NDPS) no. 904 of 2026 is rejected.

Memo of evidence submitted by the State be kept with the record.
