No.64 pk/akd W.P.A. 10811 of 2021 [via video conference] [Goutam Giri -Vs- The State of West Bengal & Ors.] Mr. Siddhartha Sarkar ... ... for the petitioner Mr. Ranjit Rajak ... ... for the State It is submitted by the learned counsel for the petitioner that there is a partition suit pending before the learned civil Judge (Senior Division), Uluberia between the writ petitioner and his brother namely, the private respondent no.4 herein. On the complaints of assault and harassment made by the petitioner, the Officer-in-charge, Shyampur Police Station, Howrah has taken out proceedings under Section 107 of the Code of Criminal Procedure against both the parties. Despite whereof, the petitioner complains that the private respondent no.4 is continuing to harass the petitioner.

The Officer-in-charge, Shyampur Police Station shall conduct an inspection of the said property and post a police constable at the said locale for a period of one week from date at the cost of the writ petitioner. The police shall ensure that there is no breach of peace in the area and shall continue to maintain vigil in the said locale so that the parties do not create disharmony against each other.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
