The petitioner participated in the 1st State Level Selection Test, 2016 for recruitment of Assistant Teachers(Life Science) in Secondary, Higher Secondary Schools (Class IX-X) and (XI-XII) under the Scheduled Caste category.

The petitioner complains that candidates in lower ranks in her category have been appointed. She cites one candidate namely Lopamudra Biswas as an instance.

The West Bengal Central School Service Commission was directed to file report on the grievance of the petitioner. Dr. Patra, learned counsel for the Commission files such report, let it be kept with the record.

It appears from the said report that the rank of the last candidate called for counseling

in the Male-Female list is 322 whereas the rank of the petitioner in the said list is 344; in respect of the Female list, the rank of the petitioner is 173 and the rank of the last candidate called for counseling is 134.

Therefore, the allegation of the petitioner is not sustainable.

The Commission has identified the said Lopamudra Biswas as a rank jumped candidate, as such is obliged to take the consequential steps but the same would not change the position of the petitioner, therefore has no relevance with the present matter.

In view of the discussion made above, the writ petition fails, accordingly WPA 10092 of 2023 is dismissed without any order as to costs.
