Petitioner(s) Ms. Arushi Rathore ... for the Petitioner(s) Mr. Suman Chakraborty ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for one year seven months and has been detained on the accusation of alleged recovery of 271 gm of heroin. According to the learned advocate, the prosecution has submitted charge-sheet; 15 witnesses have been relied upon in the charge-sheet but till date not even a single witness has been examined, although charges have been framed. Learned advocate, as such, prays that the petitioner may be released on bail on any stringent condition.

Learned advocate for the State opposes the prayer for bail and submits that charges have been framed and date has been fixed for commencement of the witness action.

Having considered the totality of the circumstances, I am not inclined to enlarge the petitioner on bail Hence, the prayer for bail of the petitioners is Rejected.

However, the learned trial court is directed to complete the evidence of the seizure list witnesses within a period of three months from the date of communication of this court. If, on an assessment of the evidence of the seizure list witnesses, the learned trial court is of the opinion that some more time would be consumed to take the trial to its logical conclusion, the learned trial court, if any application for bail is preferred on behalf of the petitioner, would consider the same leniently after the aforesaid time period is over.

Accordingly, CRM (NDPS) of is dismissed.
