Learned advocate appearing for the petitioner submits that the petitioner has been implicated on the basis of statement of co-accused and is unnecessarily being detained behind the bars.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that initially 10,000 bottles of Codeine Phosphate were seized and thereafter on the statement of the accused, the present petitioner was apprehended and from his custody another 40 bottles of Codeine Phosphate were recovered.

The antecedents of the present petitioner reflect that the petitioner was implicated in Berhampore P.S. Case No. 472 of 2021, Berhampore P.S. Case No. 217 of 2017 and Murshidabad P.S. Case No. 1002 of 2024.

Having considered the rigours of Section 37 of the NDPS Act being attracted along with the criminal antecedents of the present petitioner, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.

The application for bail, being CRM (NDPS) 905 of 2026, is, thus, dismissed.

Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
