Learned advocate appearing for the petitioners submit that petitioners are in custody since 24th of September, 2025 and although complaint has been filed there has been no progress in the case. Two of the accused persons are absconding, as such the progress of the trial at this stage is bleak. Learned advocate for the NCB opposes the prayer for bail and submits that 150 kgs of ganja of commercial quantity has been recovered in the present case and a racket is operating. Having considered that the rigors of Section 37 of the NDPS Act is attracted, the prayer for bail of the petitioners is rejected. However, the learned trial Court is directed to exhaust the process of law and if required, split up the trial of the case and proceed with the case as expeditiously as possible.

At this stage, CRM (NDPS) 1053 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
