Mr. Nemai Chandra Betal ....for the petitioner Mr. Shamim ul Bari ...for the State The grievance of the petitioner is directed against non consideration of a representation dated 21st January, 2022.

The allegation of the petitioner is against the illegal and unlawful construction by the private respondents.

The State-respondents are represented and submit that though the petitioner and the private respondents are family members, there is no objection if the above representation is considered in accordance with law.

In view of the fact that the representation was filed as far back as on 21st January, 2022 and has not yet been disposed of, WPA 9665 of 2022 stands disposed of by directing the respondent No. 5 to consider and dispose of the representation of the petitioner dated 21st January, 2022 within a period of six weeks from the date of communication of this order to the said respondent and after giving a right of hearing to all the affected parties, in accordance

with law and without being influenced by any observation made in this order.

It is made clear that there has been no adjudication on the merits of the case and all questions are left open to be decided by the concerned respondent in accordance with law.

There shall be no order as to costs.

Urgent Photostat certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
